We respect the privacy of our users. This Privacy Policy explains how we collect, use, disclose, and safeguard user’s personal data. The user of the Application may be a representative of a company or other legal entity and the register may also contain personal data of third parties if the user has provided such personal data to the Application. In case the user adds any such personal data of the user’s end customers or any other third party into the Application, the user should inform the third party of this and direct the third party to this privacy policy.

Please read this Privacy Policy carefully. IF YOU DO NOT AGREE WITH THE TERMS OF THIS PRIVACY POLICY, PLEASE DO NOT ACCESS THE APPLICATION.

We reserve the right to make changes to this Privacy Policy at any time and for any reason. We will inform you about any changes by updating the “Last update” date of this Privacy Policy. Please review this Privacy Policy to stay informed of updates. You will be deemed have accepted the changes in any revised Privacy Policy by your continued use of the Application.

Legal basis for the processing

We only collect, process and use personal data if we are permitted to do so by law or if the user has given us user’s consent. The EU General Data Protection Regulation (GDPR) serves as the legal basis for the processing of the personal data.

Purpose of the information we collect

The Application collects some information about the user and some data of third parties, introduced to the Application by the user, in scope necessary to support the functionality of the Application. The personal data may also be used for other purposes such as for:
• maintenance and development of the Application,
• marketing and communication purposes both of InstalSoft or InstalSoft Industrial Partner, being the owner of the particular configuration of the Application,
• reporting to InstalSoft Industrial Partner about the usage of the Application,
• statistical and analytical purposes.

Personal data we collect is not used for automated decision making having legal or similar consequences to the data subjects.

Scope and sources of the information we collect

The personal data is collected primarily from the user of the Application or through the user’s actions within the Application. We may collect several types of personal information and store it on the mobile device and/or our server such as:
• Contact information of the user (e.g. but not limited to: full name, postal address, e-mail address, telephone number, company name, company address)
• Contact information of the user’s customers or other third parties, given by the user to the Application
• Geographic location, including region and country
• Data about the building or house or apartment being the subject of the design made with use of the Application, including photos and building plans imported to the Application, its technical equipment and other data.

Disclosure of the collected information

The personal data collected within the usage of the particular configuration of the Application may be disclosed by InstalSoft to the adequate Industrial Partner - owner of the particular configuration.
The personal data may be also disclosed to third parties given by the user to the Application, on the project results sharing phase, with use of e-mail addresses introduced to the Application by the user, e.g. but not limited to: investor, developer, architect, plumber.

InstalSoft may be obliged to disclose the personal data to the authorities. If we believe the release of information is necessary to respond to legal process, to investigate or remedy potential violations of our policies, or to protect the rights, property, and safety of other parties, we may share your information as permitted or required by any applicable law, rule, or regulation. InstalSoft may also disclose and/or process the personal data, in accordance with applicable legislation, to defend its legitimate interests.

The personal data may be shared with third parties that perform services for InstalSoft or on its behalf, including but not limited to: data analysis, email delivery, hosting services.

Security and principles of data storage

The personal data will be mainly stored electronically. We use administrative, technical, and physical security measures to protect the data we collect. The data is stored in locked premises with restricted access. All physical copies of the data, if any, will be stored in locked premises. Only persons who need to process the personal data as part of their duties have access to and the right to process the personal information.

Anyway, the user must be aware that despite our efforts, no security measures are impenetrable, and no method of data transmission can be guaranteed against any interception or other type of misuse. Therefore, we cannot guarantee complete security of the personal information provided.

InstalSoft retains the personal data as long as it is necessary for the aforementioned purposes or as required by applicable laws. When such requirements no longer exist, the personal data will be deleted.

Options regarding the collected information – data subject’s rights

Right of access: The data subject is entitled to free of charge inspection of adequate personal data and to receive its written copy.

Right to data portability: The data subject is in some cases also entitled to receive the personal data, which she or he has provided to the controller, in a structured, commonly used and machine-readable format.

Right to object: The data subject is entitled to object at any time to process the personal data, which she or he has provided to the controller, for direct marketing purposes. End customers or other third party, who object to a user having added their personal data to the Application, may also request its removal.

Right to request rectification, erasure or restriction: The data subject is entitled to ask to rectify or erase her or his personal data in case of any legally acceptable ground (e.g., but not limited to, the data is obsolete, irrelevant or incorrect). The data subject is also entitled to request a restriction of processing of the data.

Official complaint: the data subject has the right to lodge an official complaint with the local national data protection authority.
